This was an appeal from a decision rejecting a discrimination claim in connection with the respondent's refusal to insure an individual with diabetes at standard rates.Dismissing the appeal, that the offer of inexpensive mortgage insurance by the individual's bank, pursuant to a group insurance policy negotiated between the bank and the respondent, was not a service 'customarily provided to members of the public' within s.15(1) (a) of the Human Rights Act; rather, it was a special service for qualified mortgagors. Moreover, there was a real question whether banking or insurance services were 'services' within s.15(1) (a). The individual's physical disability in this case was highly relevant to his treatment by the respondent; the court concluded it was not unjust for an insurer to refuse to insure at standard rates a person who falls into an above-average risk category.
